INFORMATION ON THE PROTECTION OF PERSONAL DATA

This information notice is provided pursuant to Article 13 Regulation 2O16/679/EU (hereinafter, for brevity, “Regulation”) and Article 13 Legislative Decree 3O June 2OO3, no. 196 (hereinafter, for brevity, also “Privacy Code”), as amended by Legislative Decree 101/2018, by LUX S.r.l., in its capacity as Data Controller.

Your data will be processed in the following ways and for the following purposes:

NATURE OF PERSONAL DATA

Processing will concern personal data communicated by you by filling in the “data collection form” and will be limited to those strictly pertinent and functional to the purposes pursued.

PURPOSE OF PROCESSING

The data provided will be used for the sole purpose of

send newsletters and email communications for marketing, promotional, advertising and/or informative purposes regarding products and news from the world of LUX S.r.l;
forwarding invitations to trade fairs, events and/or demos, possibly by means of direct telephone contact (including sms and WhatsApp).

ACCESS TO DATA

Personal data may be made accessible for the purposes identified above

– to employees, collaborators and administrators of the Data Controller, in their capacity as persons authorised to process the data;

– to third party companies or other subjects – by way of example: professional firms, consultants, etc. – third-party companies or other entities – by way of example: professional firms, consultants, etc. – that perform outsourcing activities on behalf of the Data Controller, in their capacity as Data Processors.

COMMUNICATION OF DATA

The Controller may communicate your personal data to all those subjects to whom communication is obligatory by law. These subjects will process the data in their capacity as autonomous Data Controllers.

DATA TRANSFER

The data may be communicated to the Distributors of the Controller’s products, which are also based outside the European Union; the Controller assures as of now that the transfer of data outside the EU will take place in compliance with the applicable legal provisions (Art. 44 et seq. GDPR).

LEGAL BASIS FOR PROCESSING

The legal basis of the processing is the consent freely given, which may be revoked at any time (including through the opt-out system at the bottom of the email communications you will receive). Processing carried out prior to revocation will remain valid.

NATURE OF DATA PROVISION AND CONSEQUENCES OF REFUSAL

The provision of data is optional, but refusal will make it impossible to obtain the services indicated above.

MODALITIES OF DATA PROCESSING

Personal data are stored in paper files located at the Company’s headquarters and offices and on servers located within the European Union.

It is in any case understood that the Data Controller, should it become necessary, shall be entitled to move the servers and archives also outside the EU. In this case, LUX S.r.l. assures as of now that the transfer of data outside the EU shall take place in compliance with the applicable legal provisions.

RIGHTS OF DATA SUBJECTS

You may, at any time, exercise your rights

to access your personal data
to obtain rectification or erasure of the data or restriction of processing concerning you
to object to the processing;
to data portability;
to revoke consent: revocation of consent does not affect the lawfulness of processing based on consent given before revocation;
to lodge a complaint with the supervisory authority (Privacy Guarantor).

DURATION OF PROCESSING AND STORAGE PERIOD

Personal data voluntarily provided by the data subject will be processed by the Data Controller and stored for a period of two years. Once this period has expired, the system will automatically send an e-mail to the data subject who, freely and according to his or her own will, may express his or her consent to the continuation of the processing, for the same period.

Failure to renew consent to data processing will result in the impossibility of continuing to obtain the above services.

The Data Controller subject of this information notice is LUX S.r.l., with registered office in Correggio (RE), Corso Mazzini no. 14 and with offices in Gavasseto (RE), Via A. Frank no. 62.

The updated list of Data Processors is kept at the offices of the Data Controller.
